Accounts

When you create an account with us, you must provide us with accurate, complete, and current information at all times. Failure to do so is a breach of the terms, which may result in the immediate termination of your account on our service.

You are responsible for safeguarding the password you use to access the service and for any activities or actions under your password, whether your password is with our service or a third-party service.

You agree not to disclose your password to any third-party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Ownership Terms

Regardless of how you obtain a character from Kitsusagi (paid in currency, free, event, etc.) these terms apply to all characters. Characters for Kitsusagi are only created by approved Kitsusagi designers. Characters cannot be self made. All characters are logged in the Kitsusagi Character Masterlist.

When you receive a character from Kitsusagi you become the owner of the design of the pet for non-commercial purposes. (This means: you may display the art, you may commission additional art of the design, you could put the design on a t-shirt for your personal use. You may not use the design to create anything that you make money off of. The design should always be appropriately credited.)

Kitsusagi  only recognizes a single owner for each character at a time.

Kitsusagi only recognizes the owner of a character based on the owner that is listed on our website.  Once a transaction has been completed the buyer is considered to be the owner of the character, and this character cannot be removed from them.

Players are permitted to trade or sell characters they have acquired from Kitsusagi . These trades and sales must be made through the official Kitsusagi  site.

Ownership of any Kitsusagi  characters may not be assigned to banned players.

Kitsusagi  reserves the right to use any character or art produced for their own portfolio and promotion.

You must be 16 years of age to sign up for an account on the Kitsusagi  website.

Our service may contain links to third-party websites or services that are not owned or controlled by Kitsusagi.

Kitsusagi has no control over and assumes no responsibility for the content, Privacy Policies, or practices of any third-party websites or services. You further acknowledge and agree that Kitsusagi shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such web sites or services.

We strongly suggest you read the Terms and Conditions and Privacy Policies of any third-party websites or services you visit.

Behaviour Expectations

Kitsusagi enforces certain behavioral standards for all participants. Failure to comply with these standards may lead to temporary or permanent bans, at the discretion of Kitsusagi leadership.

1. Participants are expected to treat each other with respect. While it is not necessary to be friends with everyone, being civil is a requirement.
2. Participants are prohibited from engaging in cheating. Participants must refrain from sharing disturbing, inappropriate, or harassing content.
3. Participants should address any issues directly with Kitsusagi.
4. Participants are not allowed to steal or exploit Kitsusagi assets, which include but are not limited to art, graphics, setting, and game data, outside of the Kitsusagi environment.
5. Participants are not permitted to impose plotlines, breedings, or artwork on other players.
6. Participants are expected to treat staff members with kindness.

Content Rules

1. All content provided to Kitsusagi must be created by you. Kitsusagi strictly prohibits plagiarism and art theft, maintaining a zero-tolerance policy. Making direct references to another artist's work is strictly prohibited. This includes actions such as trace overs, using AI programs, or eyeballing.
2. You may not use bases, either free to use or paid, for Kitsusagi activities unless the activity explicitly states they are allowed. 
   
   

3. Content submitted to Kitsusagi must not portray explicit sexual or adult scenes.

4. Content submitted to Kitsusagi must not depict explicit or extreme violence.

5. Content submitted to Kitsusagi must not contain derogatory or hate-filled language or imagery, including but not limited to homophobic, racist, or transphobic terms or symbols.

6. Content submitted to Kitsusagi must not feature non-consensual romantic or sexual relationships, including but not limited to incest, rape, or pedophilia.

Warnings, Formal Warnings, Suspensions and Bans

Warnings are generalized reminders about conduct and rules. They are meant to be reminders and we hope that it ends here. These can be issued by anyone on Staff.

Formal Warnings are a direct warning message sent to you by private message on Discord. This will move you from the Green list to the Yellow List on Discord. Warnings stay on your record for a year. 

Suspensions are for those that have received one warning in the past year. The prior warning doesn't have to be the related to move to a suspension. A suspension lasts for 3 months and then 6 months if a second suspension is required.  Suspensions block you from winning Kitsusagi, Customs, Breedings, or RLC.  This would put you on the Orange List for the first suspension and Red for the second. Suspensions stay on your record for a year from the end of the suspension period. 

Bans. Banned players are not permitted to participate in Kitsusagi in any way. Banned players are not permitted to sell or trade characters or other account items or make use of Kitsusagi accounts. Depending on the offense bans can happen immediately, after 1 formal warning, or after 1 formal warning and 2 suspensions.

USD Payment Terms

Payment for characters is accepted through Paypal in USD. Payment for characters is always invoiced. 

Kitsusagi reserves the right to refuse payment from any user.  Chargebacks on any paid transaction will result in automatic banning.

USD Flatsales

Kitsusagi conducts USD Flatsales to raise funds for the site or as donations for specific causes. Any event that involves a predetermined, fixed price is considered a flatsale, regardless of the method used to select winners. Payment for flatsales must be completed within 24 hours of receiving the contract. Failure to make payment within this timeframe grants Kitsusagi the right to make the design available for sale again. Engaging in chargebacks for flatsale payments will lead to an immediate ban from all Kitsusagi platforms, and the design will be put up for sale once more.

Any modified comments made during flatsales, regardless of the platform, will be deemed invalid. In cases where the winner of a flatsale is unclear, Kitsusagi reserves the final decision-making authority.

Banned Players

Here is the roster of players who have been banned. Bans apply to both primary and secondary accounts across all platforms associated with Kitsusagi. Banned players are strictly prohibited from engaging in any form of participation within the Kitsusagi community. They are also not allowed to sell or trade characters, account items, or utilize any Kitsusagi accounts.
